Welcome to Gifting 91 (www.gifting91.org), a premium gifting platform operated under Om Creations Trust. These Terms & Conditions ("Terms") govern your use of our website and the purchase of products through our platform.

By accessing, browsing or placing an order on this website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website.

1. About Gifting 91

Gifting 91 is a purpose-driven gifting platform that offers premium, handcrafted products made by specially-abled artisans associated with Om Creations Trust and Om ABODE. Every purchase supports the economic independence, skill development and dignity of neurodivergent individuals.

Our registered office is located at: Anand Niketan, King George V Memorial, Dr Elijah Moses Rd, near Kishav Ravkhadhi Road, Mahalakshmi, Mumbai, Maharashtra 400018.

2. Eligibility

• You must be at least 18 years of age to use this website and make purchases.
• By using our platform, you represent that the information you provide is accurate, complete and current.
• You are responsible for maintaining the confidentiality of your account credentials.

3. User Account

• To place orders, you may be required to create an account with a valid email address and password.
• You are solely responsible for all activity that occurs under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
• Please notify us immediately at info@gifting91.org if you suspect any unauthorised use of your account.

4. Products & Pricing

• All products listed on Gifting 91 are handcrafted by specially-abled artisans. Slight variations in colour, texture or finish are natural and reflect the handmade character of each item.
• We make every effort to display accurate product images, descriptions and pricing. However, we reserve the right to correct any errors or inaccuracies.
• Prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated.
• We reserve the right to modify prices at any time without prior notice. Price changes will not affect orders that have already been confirmed.

5. Orders & Payment

• Placing an order on our website constitutes an offer to purchase. All orders are subject to availability and confirmation.
• We reserve the right to refuse or cancel any order for reasons including but not limited to: product unavailability, pricing errors, suspected fraud or violation of these Terms.
• Payment must be completed at the time of order placement through our supported payment methods (UPI, credit/debit cards, net banking, wallets or other available gateways).
• All payments are processed securely through trusted third-party payment gateways. Gifting 91 does not store your card or banking details.

6. Shipping & Delivery

• We currently ship across India. International shipping may be available for select orders — please contact us for details.
• Estimated delivery times are provided at checkout and may vary based on your location and product availability.
• Shipping charges, if applicable, will be displayed before order confirmation.
• Risk of loss and title for items pass to you upon delivery to the shipping carrier.
• We are not responsible for delays caused by shipping carriers, natural disasters, customs or other circumstances beyond our control.

7. Returns, Refunds & Cancellations

Returns

• If you receive a damaged, defective or incorrect product, please contact us within 48 hours of delivery with photographs and your order details.
• Items must be unused, in original packaging and in the same condition as received.
• Due to the handcrafted nature of our products created by specially-abled artisans, minor variations are not considered defects and are not eligible for return.

Refunds

• Approved refunds will be processed within 7–10 business days to the original payment method.
• Shipping charges are non-refundable unless the return is due to our error.

Cancellations

• Orders may be cancelled before they are shipped by contacting us at info@gifting91.org.
• Once an order has been dispatched, it cannot be cancelled and will be subject to the return policy above.

8. Intellectual Property

• All content on this website — including but not limited to text, images, logos, graphics, product designs, videos and software — is the property of Gifting 91 / Om Creations Trust and is protected by intellectual property laws.
• You may not reproduce, distribute, modify, create derivative works of, publicly display or exploit any content from this website without prior written permission.
• The name "Gifting 91", our logo and all related marks are trademarks of Om Creations Trust.

9. User Conduct

When using our website, you agree not to:

• Use the website for any unlawful, fraudulent or harmful purpose
• Attempt to gain unauthorised access to any part of the website, servers or databases
• Interfere with or disrupt the website's operation or security
• Upload or transmit viruses, malware or any harmful code

10. Limitation of Liability

• Gifting 91, Om Creations Trust and their directors, officers, employees and representatives shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the website or purchase of products.
• Our total liability for any claim shall not exceed the amount paid by you for the specific product or service giving rise to the claim.
• The website and all products are provided on an "as is" and "as available" basis without warranties of any kind, express or implied.
